I hereby acknowledge and agree to the following terms regarding the use of my image, video, name, voice, or likeness (collectively referred to as the ‘Recording’) by Poekoothay:

1. Consent to Record and Use

I grant full, irrevocable permission to Poekoothay, its employees, contractors, licensees, assignees, and successors to:

• Photograph, film, and/or audio record me;
• Use the Recording in any format, including but not limited to print, digital, multimedia, social media, websites, and both internal and external communications;
• Edit, reproduce, publish, adapt, combine with other materials, rearrange, or otherwise alter the Recording at Poekoothay’s sole discretion;
• Use my name, image, voice, and biographical information in connection with the Recording;
• Distribute or exploit the Recording, in whole or in part, in any media now known or developed in future, globally and without time limitation.

2. Informed and Voluntary Consent

I confirm that:

• I have been fully informed of how the Recording will be used before giving consent;
• I understand the nature, purpose, and potential audience of the Recording;
• I have been given sufficient time to consider this consent form;
• I have had the opportunity to ask questions about the use of my Recording;
• My consent is given freely and voluntarily, without any pressure or coercion;
• I understand that my participation is completely optional.

3. Use for Marketing and Publication

I understand and agree that Poekoothay may use the Recording for purposes including but not limited to:

• Marketing and promotional materials;
• Educational or training content;
• Documentation and reporting;
• Social media platforms (e.g. Facebook, Instagram, LinkedIn);
• Poekoothay’s official website, newsletters, brochures, internal presentations, and other communication channels.

4. Release and Waiver of Liability

I unconditionally and irrevocably release and discharge Poekoothay, its officers, employees, agents, contractors, licensees, and assignees from:

• Any claims or legal actions arising from the use of the Recording, including but not limited to defamation, invasion of privacy, breach of confidence, tort, moral rights, or under the Competition and Consumer Act 2010 (Cth) and related state or territory legislation;
• Any liability relating to the creation, editing, publication, distribution, or public display of the Recording.

5. Ownership and Intellectual Property

I acknowledge that:

• Poekoothay is the sole and exclusive owner of all rights, including copyright and intellectual property rights, in the Recording and any material incorporating it;
• I waive any moral rights I may have in respect of the Recording;
• I am not entitled to any payment, royalties, or other compensation for the use of the Recording;
• Poekoothay is under no obligation to use the Recording.

6. Withdrawal of Future Consent

I understand that:

• Although this consent is irrevocable for existing uses, I may withdraw my consent for any future use by providing written notice to Poekoothay;
• Such withdrawal will not affect any use of the Recording made prior to the withdrawal;

7. Capacity and Legal Authority

I warrant that:

• I am over 18 years of age and have the full legal capacity to enter into this agreement;
• If signing on behalf of a minor or a person under guardianship, I have the proper legal authority to provide this consent.

This release is binding, irrevocable, and may be transferred or assigned by Poekoothay to a third party for collaborative projects.
